DOMESTIC VIOLENCE
Domestic Violence Lawyers in Cairns
In Queensland, domestic and family violence is regulated by the Domestic and Family Violence Protection Act 2012 (Qld). The purpose of this legislation is to protect the safety and wellbeing of people in relationships, prevent further violence, and ensure those responsible are held accountable. The Act gives the courts power to make protection orders and other measures designed to stop violence and promote the right of every person to live free from fear.

A DVO is a court order designed to protect a person (the “aggrieved”) from domestic and family violence. It sets conditions that the other person (the “respondent”) must follow.
If you’ve been served with an application for a Domestic Violence Order (DVO), you are called the respondent. The order seeks to place conditions on your behaviour to protect the “aggrieved”
Varying or Revoking a DVO means asking the Magistrates Court to change the conditions of an existing Domestic Violence Order (DVO). This could include adding or removing conditions, changing who is protected, or extending/reducing the length of the order.
A breach (also called “contravention”) happens when the respondent fails to comply with any condition of a Domestic Violence Order (DVO) or Temporary Protection Order. Even minor or accidental breaches can be treated seriously.
A PPN is an immediate order issued by police at the scene of a domestic violence incident. It provides urgent protection until the matter goes to court.
A TPO is made by the Magistrates Court to give short term protection until the court decides whether to make a full Domestic Violence Order (DVO).
A Full Protection Order — also called a Domestic Violence Order (DVO) — is a long term order made by the Magistrates Court to protect a person (the “aggrieved”) from domestic and family violence.
